Cx2999 is required to be given by a mortgage banker (who is also a residential mortgage loan originator) to a residential mortgage loan applicant at the time of application, pursuant to Tex. Fin. Code §157.007 and 7 Tex. Admin. Code §81.7. These sections of Texas law require the notice to contain specific language and the Texas Department of Savings and Mortgage Lending’s website publishes a model notice pursuant thereto (http://www.sml.texas.gov/ResidentialMortgageLoanOriginator/rmlo_mb_forms.html; Mortgage Banker Required Disclosure Form), of which Cx2999 is a duplicate.
The specific language has been recently changed and Cx2999 has been updated to reflect this change. In addition, the Residential Mortgage Loan Originator signature line has been removed, since it is not required or necessary.
